SB 104: Sweeping Changes to KRS 342 Proposed

Kentucky state senators Tom Buford and Dan Seum are sponsors of SB 104 which would amend numerous provisions of KRS 342. Of particular interest are proposed changes which would recognize temporary partial disability benefits, limit the duration of medical benefits, and allow claimants alleging an intentional violation of a safety statute or regulation to file both a claim for workers’ compensation benefits and maintain a civil action against the employer. The bill further proposes an increase in attorney fees, an increase in the maximum rate for temporary total benefits and temporary partial benefits and would place limitations upon the duration of permanent partial income benefits.
